Terms of Service

Consumer-facing policy information for PChero website visitors and customers.

These Terms of Service (“Terms”) govern your access to and use of https://www.pchero.com/ and the purchase of products from Shenzhen SiPuNaSi Trading Co., Ltd., trading as PChero. By using the Site or placing an order, you agree to these Terms. If you are a consumer, these Terms do not exclude or reduce any rights that applicable law does not allow you to waive.

The seller of products purchased directly from the Site is the legal entity identified above, unless the checkout or order confirmation clearly identifies a different seller.

2. Eligibility and Acceptable Use

You must have legal capacity to enter into a contract in your jurisdiction, or use the Site with any consent required by law. You may not use the Site for unlawful purposes, violate others’ rights, interfere with security, transmit malware, scrape the Site in a manner prohibited by law or these Terms, impersonate another person, or use the Services to commit fraud or abuse.

3. Accounts

If you create an account, you are responsible for providing accurate information and maintaining the confidentiality of your login credentials. Notify us promptly if you suspect unauthorized access. We may suspend an account where reasonably necessary to protect users, investigate fraud, comply with law, or address a material breach of these Terms.

4. Product Information

We aim to present product descriptions, specifications, availability, dimensions, images, and colors accurately. Displays and lighting can affect how colors appear. If information is materially inaccurate, your rights and remedies are governed by applicable law and our Return and Refund Policy.

Products may be updated, discontinued, or limited in quantity. We may set reasonable purchase limits to prevent fraud, misuse, or unauthorized resale, provided this does not unlawfully discriminate against customers.

5. Prices, Taxes, and Payment

The price and mandatory charges applicable to your order will be shown before you place it. Taxes, duties, shipping, and other charges will be handled as stated at checkout. You authorize us and our payment processors to charge the payment method you select for amounts that are clearly disclosed and authorized.

If a displayed price or product information contains an obvious error, we may correct it. If the error affects an order before acceptance, we may ask you to confirm the corrected terms or cancel the order and refund any payment. After a binding contract has formed, any correction or cancellation will be subject to applicable consumer law.

6. Orders and Contract Formation

Your order is an offer to purchase. Unless applicable law or the checkout flow provides otherwise, a binding sales contract is formed when we send a shipment confirmation or otherwise expressly accept the order. We may reject or cancel an order before acceptance for legitimate reasons such as stock unavailability, suspected fraud, payment failure, shipping restrictions, pricing errors, or legal compliance.

If we cancel an order after receiving payment, we will refund the amount due promptly. Nothing in this section limits rights you may have if a contract has already been formed under applicable law.

7. Shipping and Delivery

Processing times, delivery estimates, shipping charges, delays, tracking, customs information, and risk of loss are described in our Shipping Policy. Where a shipment is materially delayed, we will provide cancellation or refund options when required by applicable law.

8. Returns, Refunds, and Consumer Rights

Returns and refunds are governed by our Return and Refund Policy. Our voluntary return policy does not replace statutory rights. EEA and UK consumers may have a 14-day statutory withdrawal or cancellation right for many online purchases, subject to legal exceptions. Consumers may also have statutory remedies for faulty or non-conforming goods that extend beyond the voluntary return window.

9. Promotions, Discount Codes, and Gift Cards

Promotions may have additional terms disclosed at the time of the offer. Unless prohibited by law, promotional codes have no cash value, cannot be combined unless stated, and may be limited by product, customer, territory, or time. Gift-card terms, if offered, will be disclosed separately and remain subject to applicable law.

10. Reviews, Forum Posts, and Other User Content

If the Site allows reviews, forum posts, photos, comments, or other content (“User Content”), you retain ownership of your content. By submitting User Content to a public or promotional area, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and distribute that content only as reasonably necessary to operate, promote, and improve the Services, subject to applicable law and our Privacy Policy.

You represent that you have the rights needed to submit the content and that it is not unlawful, deceptive, defamatory, infringing, malicious, or harmful. We may moderate, restrict, or remove User Content where reasonably necessary to enforce these Terms, protect users, comply with law, or maintain the integrity of the Services.

If you believe content on the Site is unlawful or infringes your rights, contact us with enough detail for us to assess the report. Where applicable law requires a notice-and-action or appeal process, we will provide it.

11. Intellectual Property

The Site, brand names, logos, product photography, text, graphics, software, and other materials are owned by or licensed to us and are protected by intellectual-property laws. Except as permitted by law, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, sell, license, or commercially exploit Site content without prior permission.

We may use or link to third-party payment, hosting, analytics, social, shipping, or other services. Third-party services are governed by their own terms and privacy notices. We are not responsible for a third party’s independent acts or content, but this clause does not exclude responsibility that applicable law places on us for our own obligations.

13. Privacy and Cookies

Our collection and use of personal information is described in our Privacy Policy. Our use of non-essential cookies and similar technologies is subject to the choices and consent mechanisms described there and in our Cookie Settings.

14. Service Availability and Changes

We may update, maintain, suspend, or discontinue features of the Site. We do not promise that every feature will always be available or error-free. We will not use this clause to avoid obligations relating to an existing order or to remove mandatory consumer rights.

15. Disclaimers

To the maximum extent permitted by law, information on the Site is provided for general product and shopping purposes and the Site is provided on an “as available” basis. However, nothing in these Terms excludes any express promise we make about a product, statutory guarantee, implied term that cannot legally be excluded, or other mandatory consumer protection.

16. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot be excluded, willful misconduct or gross negligence where applicable, or breach of mandatory consumer rights.

Subject to the paragraph above, and to the maximum extent permitted by law, neither party will be liable for losses that were not reasonably foreseeable when the contract was formed. If you use the Site as a consumer, we do not exclude liability for losses caused by our breach that are a foreseeable result of that breach. If you use the Site for business purposes, additional limitations may apply to the extent permitted by law.

17. Indemnity for Unlawful or Abusive Use

If you use the Services for business or commercial purposes, or submit User Content, you agree to be responsible for third-party claims, losses, and reasonable costs caused by your unlawful use of the Services, your infringement of another person’s rights, or your material breach of these Terms, to the extent permitted by law. This section does not impose an unfair indemnity on consumers for ordinary use of the Site.

18. Suspension and Termination

You may stop using the Site at any time. We may suspend or terminate access where reasonably necessary because of a material breach, fraud, security risk, legal requirement, or misuse. Provisions that by their nature should survive termination, such as intellectual-property protections and accrued payment obligations, will survive.

19. Governing Law and Consumer Jurisdiction

Subject to the mandatory consumer protections described below, these Terms and contracts with us are governed by the laws of the People’s Republic of China.

If you are a consumer, this choice of law does not deprive you of mandatory protections that apply under the law of your habitual residence where those protections cannot be waived. If you are an EEA consumer and we direct our commercial activities to your country, applicable EU rules may also allow you to bring a consumer claim in the courts of your place of domicile. UK and U.S. consumers retain any non-waivable jurisdiction and venue rights provided by applicable law.

20. Changes to These Terms

We may update these Terms prospectively to reflect changes in the Services, business practices, or law. The current version will be posted on the Site with the updated date. Changes will not retroactively reduce rights relating to an order already accepted unless the law permits and the change is properly agreed.

21. Severability, No Waiver, and Entire Agreement

If a provision is found unenforceable, it will be limited or severed only to the extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These Terms, together with policies and order terms expressly incorporated into them, form the agreement governing your use of the Site and purchases, subject to mandatory law.
